1. Acceptance of Terms

Welcome to Critter Crew AI! By downloading, installing, or using our mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree with these Terms, please don't use the App.

These Terms constitute a legally binding agreement between you and Critter Crew AI ("we," "us," or "our").

2. Eligibility

Age Requirements:

• You must be at least 13 years old to create an account
• If you're under 18, you must have permission from a parent or guardian
• Parents/guardians are responsible for their children's use of the App

3. Account Registration

To use certain features of the App, you may need to create an account:

• Accurate Information: Provide a valid email address
• Account Security: Keep your login credentials confidential
• Your Responsibility: You're responsible for all activities under your account
• One Account: Each user is permitted one account

4. Free and Premium Services

4.1 Free Version

The free version includes:

• Access to 3 virtual pets (Biscuit, Leon, and one more)
• Basic games (puzzles and trivia)
• Pet logs and activity tracking
• Limited AI assistant chats
• Photo gallery (up to 20 photos)

4.2 Premium Subscription

Premium subscription ($12.99/month) includes:

• UNLIMITED virtual pets
• Access to rare and legendary pets
• All games unlocked
• Unlimited AI assistant chats
• Unlimited photo storage
• Email reminders
• Custom virtual homes for pets
• Ad-free experience

4.3 Subscription Terms

• Billing: Charged monthly to your Apple ID or Google Play account
• Auto-Renewal: Subscription automatically renews unless cancelled 24 hours before the end of the current period
• Cancellation: Cancel anytime through your device's subscription settings
• No Refunds: We don't offer refunds for partial months (Apple/Google policy)
• Price Changes: We may change subscription prices with 30 days notice

5. User Content

5.1 Your Content

You retain ownership of content you create in the App, including:

• Pet names and customizations
• Photos uploaded to your gallery
• Activity logs and notes
• Chat messages with AI

5.2 License to Us

By using the App, you grant us a limited license to:

• Store and display your content within the App
• Use anonymized data to improve our services
• Back up your content on our servers

Note: We will NEVER share your personal content publicly or sell it to third parties.

5.3 Prohibited Content

You may NOT upload or create content that is:

• Illegal, harmful, or offensive
• Abusive, harassing, or threatening
• Sexually explicit or pornographic
• Infringing on intellectual property rights
• Spam or advertising

6. Acceptable Use

You agree NOT to:

• Reverse engineer, decompile, or hack the App
• Use bots, scripts, or automated tools
• Attempt to gain unauthorized access to our systems
• Interfere with other users' experience
• Use the App for commercial purposes without permission
• Share your account with others
• Circumvent any Premium features or payment systems

7. Intellectual Property

All content in the App is our property or licensed to us:

• App Design: UI, graphics, and layout are copyrighted
• Pet Characters: Biscuit, Leon, and all other pets are our original creations
• AI Technology: Biscuit AI and game algorithms are proprietary
• Trademarks: "Critter Crew AI" and our logo are trademarks

You may not copy, reproduce, or distribute any App content without written permission.

8. AI Assistant Disclaimer

Biscuit AI provides pet care tips and entertainment:

• For Virtual Pets Only: Advice is for virtual pets in the App, not real animals
• Not Professional Advice: Don't use AI responses for real pet medical or behavioral issues
• Entertainment Purpose: AI is designed for fun and engagement
• Accuracy: We don't guarantee AI responses are 100% accurate

9. Third-Party Services

The App integrates with third-party services:

• Apple App Store / Google Play: Subject to their terms
• Payment Processors: Subscriptions managed by Apple/Google
• Email Service: Reminder emails sent via SendGrid
• Cloud Storage: Data stored on Firebase servers

We're not responsible for third-party services or their policies.

10. App Availability and Modifications

10.1 Service Availability

• We strive for 99% uptime but don't guarantee uninterrupted service
• Maintenance windows may temporarily disrupt access
• We're not liable for downtime or data loss

10.2 Updates and Changes

• We may add, modify, or remove features at any time
• Updates may be required to continue using the App
• We'll notify users of major changes

11. Termination

11.1 By You

You can terminate your account anytime by:

• Going to Settings → Account → Delete Account in the App
• Emailing us at crittercrewboss@crittercrewai.com
• Canceling your subscription through your device settings

11.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• You abuse our services or other users
• Your account is inactive for over 1 year (free accounts)

Note: Premium subscribers will receive warnings before termination unless there's fraud or illegal activity.

12. Disclaimers

We disclaim all warranties, including:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security of data transmission

13. Limitation of Liability

To the maximum extent permitted by law:

• We're not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the last 12 months (or $50, whichever is greater)
• We're not liable for third-party services or content
• You use the App at your own risk

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use of the App
• Content you upload or create
• Your violation of any laws or third-party rights

15. Dispute Resolution

15.1 Informal Resolution

If you have a problem, please contact us first at crittercrewboss@crittercrewai.com. We'll work to resolve issues amicably.

15.2 Governing Law

These Terms are governed by the laws of the United States and the state in which our business is registered.

15.3 Arbitration

Any disputes will be resolved through binding arbitration rather than in court, except for:

• Small claims court matters (under $10,000)
• Intellectual property disputes

16. Changes to Terms

We may update these Terms from time to time:

• We'll notify you of material changes via email or in-app notification
• Continued use of the App after changes means you accept the new Terms
• The "Last Updated" date will always reflect the most recent version

17. Miscellaneous

17.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and us.

17.2 Severability

If any provision is found invalid, the remaining provisions remain in effect.

17.3 No Waiver

Our failure to enforce any right doesn't waive that right.

17.4 Assignment

You may not transfer your account or these Terms. We may assign our rights to another company.
